The 34-year-old was arrested at HM Naval Base Clyde near Helensburgh, Argyll and Bute, at about 17:00 on Thursday. He had been expected to appear at Dumbarton Sheriff Court on Monday – but the Crown Office said that "after full and careful consideration of the facts and circumstances of the case" the man had been freed pending further inquiries. Prosecutors said the case against him was still live and under consideration – but that there would be no proceedings against a 31-year-old Romanian woman who was also arrested at the base. She has been released without charge following consideration of the "available admissible evidence," although the Crown said it reserved the right to proceed with the case in the future should further evidence become available.
