Federal judge blocks California from enforcing ICE mask ban

U.S. District Judge James Donato issued a preliminary injunction in San Francisco on Monday, blocking a new California law that sought to prohibit federal immigration agents from wearing masks or facial coverings during enforcement actions. The ruling prevents the state from enforcing the ban against Immigration and Customs Enforcement (ICE) and Customs and Border Protection (CBP) officers, as the judge determined the statute likely violates the intergovernmental immunity doctrine. California lawmakers originally passed the measure in response to concerns that masked federal agents created an atmosphere of intimidation and lacked accountability during public arrests. In his decision, Judge Donato argued that the California law was discriminatory because it specifically targeted federal personnel while exempting state and local law enforcement from similar restrictions. The state had argued that the ban was necessary to ensure that residents could identify those taking part in law enforcement activities, particularly in immigrant communities where trust in authorities is often fragile. However, the court found that California cannot dictate the operational equipment or uniforms of federal employees in a way that singles them out from state counterparts. Despite the block on the facial covering ban, the ruling does not grant federal agents total anonymity. The judge maintained that agents are still required to wear clear identification, including their specific agency name and badge numbers, while on duty.
